Section 31
Case moving

(1) Cases, appeals, petitions and reports pending in the District Courts existing at the commencement of this Act shall automatically be transferred to the respective District Courts established after the commencement of this Act.
(2) When the area of ​​a district is divided into two provinces according to the constitution at the time of the commencement of this Act, until the delimitation of such district is determined, in accordance with this Act or prevailing law within such district, the Government of Nepal shall notify the Nepal Gazette in consultation with the Council of Justice in the case of initiation of proceedings by the District Court and hearing of appeals. The district court will look at the publication. The High Court hearing the appeal against the decision of such district court will hear the appeal against the decision made by that district court or any body or official according to the prevailing law.
(3) Notwithstanding anything written in sub-section (1), the cases, petitions and reports pending in the district court of such district due to the alteration of the boundaries of a district in accordance with the Constitution shall be transferred to the district court designated by the Government of Nepal in consultation with the Judicial Council and published in the Nepal Gazette.< br> (4) Cases, petitions and reports that have been filed in the Appellate Court at the time of commencement of this Act shall be transferred to the High Court designated by the Government of Nepal after the commencement of this Act in consultation with the Judicial Council and published in the Nepal Gazette.
(5) After the commencement of this Act, if the jurisdiction of any High Court or District Court is altered after the commencement of this Act, the boundaries of any Province are changed and the jurisdiction of any High Court or District Court is changed, the cases, petitions and reports pending in such High Court or District Court shall be referred to the High Court or High Court designated by the Government of Nepal in consultation with the Council of Justice. will move to the district court.
